01. What are the legal issues that the employer must take into account?
- Minimum wage it cannot be lower than the minimum wage in the Romanian economy or, if applicable, less than the salary established by the binding collective agreements in your sector of activity.
- Maximum working time and the minimum rest periods established by Romanian law depending on the field of activity must be observed.
- Health and safety at work I am in charge of you, as in the case of an employee of Romanian nationality.
- Conditions of employment for young people and pregnant women they also fall under Romanian law and must be respected exactly.
- Discrimination it is becoming an increasingly acute problem in today’s society and is being punished by the Romanian authorities. We advise you to consider equal treatment between women and men and other rules on the prevention of discrimination, especially since your employee is not a Romanian citizen.
02. Residence permits
- What is the procedure for residence permits? From the moment the candidate arrives in the country, he can already start the activity in the company based on the work permit and the employment procedures can already be done: occupational medicine and the individual employment contract. In order to apply for a work permit, you need a series of documents that we will send to you by email before the arrival of the candidates. Based on these, we will make the online requests on the immigration portal and we will let you know when the over-the-counter appointment has been set up to present you with the candidates. They should be informed that pictures will be taken of them and fingerprints will be taken.
- How long is the residence permit issued? According to the law, the residence permit is obtained within 30 days from the date when the candidate presented himself at the counter and his file was accepted, his pictures were taken and his fingerprints were taken.
- Who can lift a residence permit? The candidate can pick up the permit directly based on the passport and the registration receipt at the counter. The employer can also pick up the candidate’s residence permit based on a notarized power of attorney signed by both parties and the registration receipt at the counter.
- How long do I have to apply for permits? To avoid penalties, the application file must be filed at the counter no later than 30 days before the expiration of the 90-day period from which the applicant obtained the visa in Asia. This time the passport appears and the remaining time can be calculated.
- What is the validity of a residence permit? For candidates who first arrived in Romania, the residence permit is valid for one year. If the contract is to be continued, the request for the new permit is made no later than 30 days before the expiration of the previous one and the same documents are prepared as upon their arrival in Romania.
03. Employment contract according to Romanian legislation:
- When is the individual employment contract (CIM) drawn up? From a legal point of view, candidates can start working starting the day after they arrived in Romania. CIM is prepared based on passport data and in REVISAL there is the option to select “Other documents of the employee” in the absence of a CNP, to allow you to complete the registration process of the candidate.
- Will they be employed as Romanian employees or are there other distinct conditions? Candidates will be employed as Romanian employees and the same procedure will be followed according to Romanian law.
- Manage CNP Lack: In the absence of a CNP, how is the 112 form completed? This process differs from company to company and depends on the internal organization of each.
- HRIS registration: How to register in CHARISMA in the absence of a CNP? Each company has its own payroll system that may differ from one to another. We recommend that you discuss viable accounting options or call the support department of the company that offered you the payroll program.
- COR function classification: Can I recruit candidates for a position other than the one I applied for? Not. The applicant will not be accepted for the permit file and will have to leave the country at the end of the 90-day period for which he obtained the visa.
- What is the solution for employment in another COR position compared to the one for which approval has already been requested and obtained? After obtaining the residence permit of the candidate, a new work permit is requested and upon obtaining it, a request is made for updating the residence permit. All these involve new taxes that will be borne by the employer and the legal deadline for obtaining each of them is 30 days.
- Disciplinary offenses. In case of violations, the procedure is the same as for any Romanian employee. It is important to make them very clear from the beginning to the specifications of the Internal Regulations of the company (delays, unexcused absences, etc.).

- Medical leave / Rest leave / Unpaid leave Based on the CIM and the taxes paid to the state, the candidates benefit from medical insurance and can request medical leave in case of health problems.
04. Are there any tax or other benefits if you hire non-EU nationals?
There are no tax benefits for those of you who want to hire foreign nationals.
05. What languages do International Work Finder candidates recruit?
Depending on the requirements of the Romanian companies that use our team, we assume the recruitment of employees that best meet the employment criteria.
From our experience, Asians learn Romanian quickly because they have openness and a desire to adapt. But first, they are required to be able to communicate in English.
06. What happens if I go bankrupt?
Although we would like you not to go bankrupt, situations of force majeure can arise. The pandemic has prepared us for such situations.
Because the work visas and residence permits of Asian workers are valid for 2 years, if the employment contracts provide for force majeure clauses and these unforeseen situations arise before their expiration, if you ask us for help, we will strive to place the workers to other employers.
07. Why does it take 3-4 months to bring in workers?
The process of bringing in Asian workers is a very complex one, and the bringing time of 3-4 months from the selection results from the legal, necessary and mandatory procedures, but it is often worth the wait. We also have solutions in this regard! Recruitment must be done carefully and correctly, in order to deliver the best quality, according to the job description and according to what we find in Asia. For this process we need between a week and a month, depending on the qualification and the financial offer of the employer. The work permit takes between 1 and 2 months for the local authorities, and the work visa takes between 2 weeks and 2 months, depending on the country of origin of the Asians.
08.What if I don't know how to do what they were recruited to do or I can't cope?
We only recruit candidates who have worked in related industries before, we inform candidates in advance about the activity they will carry out in Romania, the program and all the other necessary aspects. We test them if necessary, either online or we go on site if the situation requires it (a large number of employees). The interview can also be done online, and the employer can make the selection based on these real-time or recorded interviews.
09.Arrival of candidates, Meals, Shopping:
- Arrival of candidates in the country: who takes over the candidates from the airport? One of our representatives will be at the airport to contact the immigration staff and complete the procedures for entering the country. The employer must send a manager to pick up the candidates and provide them with transportation to the location where they will be accommodated.
- The food: Asians mostly eat rice-based foods. We recommend that, in the first days, until they get used to the location, talk directly with them and get their specific ingredients. After 2-3 days they will be able to cook on their own. Meal vouchers can also be provided. You can provide them with a kitchen equipped with all the necessary utensils, they can cook their own dishes with which they are used.
- When they come to the country, do they have money? It is possible for them to come with 10-20 Euros, but if you want to help them, you can give them an advance on their salary so that they can manage until the salary day.
- Do they have a minimum hygiene kit? Most candidates are informed by the Asian agency that they have a strict need for hygiene items, clothing, etc. If they inform you that they need certain items, you can ask a driver to go with them, to show them the surroundings, the shops. It is normal to have a restraint at first because I do not know the area, but after they get used to it, they can go and buy the necessary things on their own and they will not need your guidance.
- How do you dress? Just like us. The only difference is that in their country it is much warmer than in our country in winter, this depends on the region where the candidate comes from. Our recommendation is that, in case they are more difficult to adapt to the temperatures in Romania, to buy them uniform work or to offer them the possibility to go somewhere to buy thicker clothes.
- How do we get along with them? Most candidates know English and can communicate with them. If there is a situation in which you do not get along with a candidate, you can always download translation programs based on voice commands from the internet.

10.What is my role as an employer in the recruitment process?
Even if the most bureaucratic part falls on our shoulders, we will need a little help from you as an employer:

- We are recruiting but you have the last word on the selection side, either based on a recorded interview or a live interview with potential workers.
- We need assistance with contracts and power of attorney for filing work permits and obtaining visas and residence permits.
- And last but not least, we will be able to collaborate on the logistics (accommodation and meals) as well as the process of induction and adaptation to culture.
11.Delegations or leaving the company
- What do I do if a candidate decides to leave? According to the law, the employer has the obligation to notify the General Inspectorate for Immigration of any arrival or departure of foreign employees, whether they decide to go to another company, whether they go home on vacation, etc. Be very careful if you change the place of accommodation / position they are employed in, in this case the residence permit must be modified.
- What do we do if a candidate behaves violently? Any act that contravenes the law is reported to the Police / General Inspectorate for Immigration and will be sanctioned according to the law.
- Can I delegate them to another office? Yes, the candidates can be delegated according to the Romanian law and the registrations are made in REVISAL for this purpose. If this happens for a longer period of time, immigration must be notified and, depending on the case, residence permits must be renewed.
- Can I keep their passports / permits? By law, the employer has no right to withhold the employee’s identification documents.
